The present-day dossier of the blacksmith in black Africa and elsewhere is made up of a considerable bulk of literature. The various documents are not homogenous: some are confined to providing us with raw information—a sort of implicit phenomenology; others tend to be in support of, for the most part, particular theories, and, in fairly rare cases, general theories. Engendered by the ambiguous status of this artisan at once manipulator of fire and of chtonic powers, this literature attempts to put (...) forward conclusive answers to situations which are, either in a real sense or in an apparent sense, contradictory. Thus it is that the blacksmith is at times the marginal citizen, something of an outcast who is despised above all else, and at others the equivalent of the figure holding the reins of power, if not this figure in person; in this way his image travels from one extreme of recognised social standing to the other. But in almost every instance he is recognised as possessing the technical knowledge which is the determining factor for the functioning of societies, whatever the category of social formation in which they may be included. When the benefits of surgery do not outweigh the harms or where they do not clearly do so, surgical interventions become morally contested. Cutting to the Core examines a number of such surgeries, including infant male circumcision and cutting the genitals of female children, the separation of conjoined twins, surgical sex assignment of intersex children and the surgical re-assignment of transsexuals, limb and face transplantation, cosmetic surgery, and placebo surgery.

La recherche conduite dans le cadre de la thèse de doctorat (CROUZIER 2003) a été focalisée sur l’analyse des liens professionnels tissés entre les dispositifs RASED et les équipes éducatives des écoles primaires. Nous avons co-construit les données nécessaires à leur compréhension et choisi des traitements combinant les avantages du quantitatif et du qualitatif. Nous avons en particulier retenu une approche statistique fondée sur l’analyse statistique textuelle (LEBART SALEM 1994) pour explorer le corpus construit à partir d’entretiens auprès d’un échantillon (...) de professionnels concernés par les aides spécialisées à l’école primaire. Le choix de l’approche statistique s’inscrit dans une conception du raisonnement statistique développée par J.C. Régnier (REGNIER 1998, 2002). L’opérationnalisation du traitement a été rendue possible par le recours à un outil informatique, le logiciel S.P.A.D. (Système Portable de l’Analyse des Données) du CISIA. Cet outil permet de décrypter les corpus obtenus par des méthodes d’analyse factorielle de correspondances multiples. Différentes procédures ont été appliquées aux corpus bruts puis codés. Cette approche “quantiqualitative”, apportant une plus-value interprétative, décrypte de façon singulière la complexité de la collaboration entre acteurs. Abstrac: This PhD dissertation (CROUZIER 2003) focuses on the analysis of the professional relationships between the French institutional comprehensive remedial scheme known as RASED and educational teams in primary schools. We have jointly identified the data relevant to a thorough understanding of such relationships, opting for a method of data processing combining the advantages of both quantitative and qualitative approaches. We have chiefly relied on a specific brand of textual statistics (LEBART SALEM 1994) in order to explore a corpus made up of interviews with the primary school staffs involved in the scheme. The statistical approach accords with the conception of statistical processing developed by JC Regnier (REGNIER 1998, 2002). The processing itself has been engineered thanks to CISIA’s software, known as SPAD (portable data processing system). It has enabled us to decrypt the different types of corpuses through Correspondence Analysis (CA). Both the raw and the coded corpuses have been submitted to different types of processing. The approach, combining quantitative and qualitative elements, opens up on to new powerful interpretative insights and sheds a new light on the intricate network of interaction between the people involved. Despite the importance of his work, Marville has long been an enigma in the history of photography, in part because many of the documents about his life were thought to have been lost in a fire that destroyed Paris's city hall in 1871. Based on meticulous research, this volume reveals many new insights into Marville's personal and professional biography, including the central fact that he was born Charles-Franðcois Bossu. He shed this name and adoptedthe pseudonym Marville when he began his career as an illustrator in the 1830s. The idea that some of God's past beliefs depend on our future actions has a long history, going back to Origen in the third century CE. However, it is not always clear what this idea amounts to, since it is not always clear what kind of dependence is at issue. This paper surveys five different interpretations of dependence and, in each case, considers the implications for the debate over theological fatalism. During the Algerian struggle, Fanon warned us about the influence on politics of ‘the few European colonialists, powerful, intractable, those who have at all times instigated repressions, broken the French democrats, blocked every endeavor within the colonial framework to introduce a modicum of democracy into Algeria’. Is this remark still pertinent? How does Frantz Fanon help us understand current reactionary politics in France? Is his analysis of the French Left still pertinent? How does colonial discourse weigh on the postcolonial present? (...) In this article, I explore current expressions of French postcolonial reactionary politics focusing on an event in Reunion Island, a French postcolonial territory. I argue that it is important to observe what is happening in French postcolonial territories because they remain laboratories for repressive policies and discourses. What I call the discourse of ‘French Algeria’, a mix of revisionist history, resentment, wounded narcissism and racism, embodies a political trend that seeks to counter the small progress made in rewriting history from the point of view of the colony in France. The debate over persistence is often cast as a disagreement between two rival theories—the perdurantist theory that objects persist through time by having different temporal parts at different times, and the endurantist theory that objects persist through time by being wholly present at different times. This way of framing the debate over persistence involves both an important insight and an important error. Unfortunately, the error is often embraced and the insight is often ignored. The existence of dysfunctions precludes the possibility of identifying the function to do F with the capacity to do F. Nevertheless, we continuously infer capacities from functions. For this and other reasons stated in the first part of this article, I propose a new theory of functions (of the etiological sort), applying to organisms as well as to artefacts, in which to have some determinate probability P to do F (i.e. a probabilistic capacity to do F) is a necessary condition (...) for having the function to do F. The main objective of this paper is to justify the legitimacy of this condition when considering artefacts. I begin by distinguishing “perspectival probabilities”, which reflect a pragmatic interest or an arbitrary state of knowledge, from “objective probabilities”, which depend on some objective feature of the envisageditems. I show that objective probabilities are not necessarily based on physical constitution. I then explain why we should distinguish between considering an object as a physical body and considering it as an artefact, and why the probability of dysfunction to be taken into account is one relative to the object as member of an artefact category. After clarifying how an artefact category can be defined if it is not defined in physical terms, I establish the objectivity of the probability of dysfunction under consideration by showing how it is causally determined by objective factors regulating the production of items of a definite artefact type. In coming decades, fetal medicine may become a routine part of reproductive care. The measures pregnant women now take to protect fetal health are largely generic, like restricting their diets and using supplements. Relatively few interventions are based on specific conditions revealed by ultrasound or genetic testing. A recent finding, though, may herald a dramatic rise in “personalized” fetal medicine: certain drugs already approved by the Food and Drug Administration can apparently boost neural growth in fetuses with Down syndrome, improving (...) cognitive functioning in the future child. Many more condition‐specific findings are likely in the near future. But as commentators have frequently observed about prenatal testing, technologies that appear to increase reproductive options also complicate and constrain them. (shrink)

In this article, I argue that there is no compelling therapeutic ‘need’ for human nuclear genome transfer to prevent mitochondrial diseases caused by mtDNA mutations. At most there is a strong interest in this technology on the part of some women and couples at risk of having children with mitochondrial disease, and perhaps also a ‘want’ on the part of some researchers who see the technology as a useful precedent – one that provides them with ‘a quiet way station’ in (...) which to refine the micromanipulations techniques essential for other human germline interventions and human cloning. In advance of this argument, I review basic information about mitochondrial disease and novel genetic strategies to prevent the transmission of mutated mitochondria. Next, I address common features of contemporary debates and discussions about so-called mitochondrial replacement. First, I contest the cliché that science-and-technology is fast outpacing ethics. Second, I dispute the accuracy of the term ‘mitochondrial replacement’. Third, I provide a sustained critique of the purported ‘need’ for genetically-related children. In closing, I call into question the mainly liberal defense of human nuclear genome transfer. I suggest an alternative frame of reference that pays particular attention to issues of social justice. I conclude that our limited resources should be carefully expended in pursuit of the common good, which does not include pandering to acquired desires. (shrink)

Jon Elster reports that in 1940, and again in 1970, the U.S. draft lottery was challenged for falling short of the legally mandated ‘random selection’. On both occasions, the physical mixing of the lots appeared to be incomplete, since the birth dates were clustered in a way that would have been extremely unlikely if the lots were fully mixed. There appears to have been no suspicion on either occasion that the deficiency in the mixing was intended, known, or believed to (...) favor or disfavor any identifiable group. Ryan Wasserman explores a range of fascinating puzzles raised by the possibility of time travel, with entertaining examples from physics, science fiction, and popular culture, and he draws out their implications for our understanding of time, tense, freedom, fatalism, causation, counterfactuals, laws of nature, persistence, change, and mereology.

When a patient lacks decision-making capacity, then according to standard clinical ethics practice in the United States, the health care team should seek guidance from a surrogate decision-maker, either previously selected by the patient or appointed by the courts. If there are no surrogates willing or able to exercise substituted judgment, then the team is to choose interventions that promote a patient’s best interests. We argue that, even when there is input from a surrogate, patient preferences should be an additional (...) source of guidance for decisions about patients who lack decision-making capacity. The patient preference predictor is a proposed computer-based algorithm that would predict the treatment preferences of decisionally incapacitated patients. Incorporation of a PPP into the decision-making process has the potential to improve implementation of the substituted judgement standard by providing more accurate predictions of patients’ treatment preferences than reliance on surrogates alone. Yet, critics argue that methods for making treatment decisions for incapacitated patients should be judged on a number of factors beyond simply providing them with the treatments they would (...) have chosen for themselves. These factors include the extent to which the decision-making process recognises patients’ freedom to choose and relies on evidence the patient themselves would take into account when making treatment decisions. These critics conclude that use of a PPP should be rejected on the grounds that it is inconsistent with these factors, especially as they relate to proper respect for patient autonomy. In this paper, we review and evaluate these criticisms. We argue that they do not provide reason to reject use of a PPP, thus supporting efforts to develop a full-scale PPP and to evaluate it in practice. There are no data in this work. (shrink)

This paper critically engages ethical issues in the allocation of novel, and potentially costly, health care resources to patients with disorders of consciousness. First, we review potential benefits of novel health care resources for patients and their families and outline preliminary considerations to address concerns about cost. We then address two problems regarding the allocation of health care resources to patients with disorders of consciousness: (1) the problem of uncertain moral status; and (2) the problem of accurately measuring the welfare (...) burdens these resources would relieve. We conclude by suggesting that opportunity-based frameworks might complement standard approaches for justifying resources allocation to patients with disorders of consciousness. (shrink)

Much of this interest has been tied to efforts to draw up national and international plans to deal with a global pandemic. It is common for these plans to state the importance of drawing upon a (...) well-developed ethics framework and we argue that this framework should reflect the values and insights of feminist relational theory. More specifically, we argue that pandemic planning must be squarely situated in the larger realm of public health and that an ethics framework for public health will be one that recognizes the need to pay particular attention to the vulnerability of subpopulations lacking in social and economic power. We propose an ethics framework for public health that builds on the notions of relational personhood (including relational autonomy and social justice) and relational solidarity. We are gratified by Nelson's response to our commentary. It shows, for the first time, an appreciation of the distinctive character of our criticism of individual decisions to test and terminate for fetal impairment. Although we still find much to disagree with in Nelson's characterization and critique of our views, he has given us a welcome opportunity to clarify and develop them.

In this commentary, I explore the usefulness of the framework Abram Brummett and Erica K. Salter present in their article “Mapping the Moral Terrain of Clinical Deception.” Deception cases are divisive because they nearly always evoke the metadilemma of clinical ethics: a clash between duties (in these cases, truth telling) and consequences (whatever good might come of the lie). Here, I describe a patient case in which the clinical team considered deceiving a patient about his pain‐medicine dosage in exchange for (...) his allowing the clinicians to properly care for his percutaneous endoscopic gastrostomy tube stoma, so as to prevent infection. Applying the framework that Brummett and Salter have developed helped our clinical team parse the numerous complex issues involved. The nuances of our case also illustrated additional ways in which the ethics of deception needs to be further refined. (shrink)

This comment argues for increased tolerance of privacy risks in the Internet activity of adults with intellectual disabilities. Excessive caution about such risks denies those individuals not only the great benefits of Internet use but also the difficult but valuable experiences of loss, disappointment, and hurt associated with those risks. A level of risk-aversion appropriate for small children will be disrespectful for adults with intellectual disabilities. To the extent that additional safeguards are justified, they are better achieved through individualized security (...) and privacy settings than through caregiver oversight. (shrink)

There is a perpetrator historiography of the Holocaust and a Jewish historiography of the Holocaust. The former has received the lion’s share of attention in bioethics, particularly in the form of warnings about medicine’s potential for complicity in human atrocity. However, stories of Jewish physicians during the Holocaust are instructive for positive bioethics, one that moves beyond warnings about what not to do. In exercising both explicit and introspective forms of resistance, the heroic work of Jewish physicians in the ghettos (...) and concentration camps tells us a great deal about the virtues and values of medicine. In this article, we frame the stories of four of these Jewish physicians in ways that are instructive for contemporary medicine. By far, the most widely recognized and discussed figure is Viktor Frankl, whose work on hope and the meaning of suffering remains essential insofar as medicine inherently confronts disease and death. Less discussed in bioethics and medical humanities are the cases of Mark Dworzecki, Karel Fleischmann, and Gisella Perl. Dworzecki’s efforts to encourage others in the Vilna Ghetto to document their experiences illustrates the power of narrative for the human experience and the notion of ethics as narrative in the face of suffering. Fleischmann’s art underscores not only the importance of reflective practices for professionals as a form of simultaneous introspection and testimonial, but illuminates hope amid sheer hopelessness. This hope, which was comparatively implicit in much of Fleishmann’s art, is explicated as a method by Frankl, becoming a form of therapy for both physicians wrestling with their professional work, and patients wrestling with their illnesses and diseases. Finally, Perl’s resistance to Mengele’s orders highlights the importance of moral action, not just reflective reaction. The experiences of each of these figures, while certainly located in the unique horrors of Holocaust Germany, portends lessons for today’s physicians faced with moral distress and ethical dilemma in the face of suffering, interpersonal relationships, and socio-political conflicts that increasingly test the professed ideals of medicine. In this article we briefly tell the story of each of these physicians and connect the lessons therein to contemporary medical practice. (shrink)

In this 2001 volume a group of leading philosophers address some of the basic conceptual, methodological and ethical issues raised by genetic research into criminal behavior. The essays explore the complexities of tracing any genetic influence on criminal, violent or antisocial behavior; the varieties of interpretations to which evidence of such influences is subject; and the relevance of such influences to the moral and legal appraisal of criminal conduct. The distinctive features of this collection are: first, that it advances public (...) discussion while clarifying the debate about genetic research and criminal behavior; second, that it explains scientific controversies about behavioral genetics in lucid, non-technical terms; third, that it demonstrates how the possible findings on genetics and crime bear on fundamental issues of moral and criminal responsibility.
